Pacific Seafood's Appeal to go to Arbitration on Merger with Ocean Gold Denied

The Ninth Circuit Court of Appeals on Tuesday affirmed two lower court decisions that will keep an injunction in place against a merger between Pacific Seafoods and Ocean Gold, and not allow the suit to go to arbitration.
The appeals are from an antitrust action brought by a group of West Coast fishermen against Pacific Seafood and Ocean Gold Seafoods which started in 2010 and was settled in 2012. Their settlement is documented in a Resolution Agreement.
In December 2014, Pacific Seafood informed the other parties to the Resolution Agreement that Pacific Seafood was planning to acquire Ocean Gold. A second group of West Coast fishermen then filed the present action against the processors, alleging ...
