Subway Attempts to Enjoin King & Prince in Trademark Dispute over ‘Seafood Sensations’

King & Prince has used its trademarked term ‘Seafood Sensations’ for many years to describe a surimi product made from surimi, shrimp, and a small amount of crabmeat and flavorings.
Recently, the company’s lawyers wrote to the Subway Chain, asking them to cease and desist from using the term ‘Subway Seafood Sensations’ to describe their seafood salad (surimi) based sandwiches.
This description has not been on all subway menus, and is not the only way in which the company describes its seafood sandwiches, for example also featuring a ‘crab and lobster’ sandwich.
Subway’s Seafood Sensation is an optional item, available to franchisees who order it.
Subway’s Parent Company - Doctors Associates Inc - has counter-sued King & Prince to try and enjoin them from a trademark infringement suit....
